Terms of Service
1. Who we are
Fitness-Elevated ("we," "us") provides online and in-person strength & conditioning coaching, exercise programming, and general fitness and nutrition education (the "Services"), delivered through this website and our member application at fitness-elevated.com/app, operated by Dymond Unutoa (CSCS, PTA, LMT, TPI-Certified).
2. Not medical advice
The Services are fitness coaching and education — not medical care, physical therapy, psychological care, or medical nutrition therapy, and no provider–patient relationship is created. Consult your physician before beginning any exercise or nutrition program. If you experience concerning symptoms during exercise, stop and seek medical attention. Members additionally sign an Enrollment Agreement & Waiver that governs training risks in detail; where these Terms and a signed Enrollment Agreement overlap, the Enrollment Agreement controls for that member.
3. Accounts
Membership accounts require accurate information and a working email address. You are responsible for keeping your login credentials confidential and for activity under your account. Accounts are personal and may not be shared. We may suspend or close accounts that violate these Terms or misuse the platform.
4. Memberships, payments & beta access
- Coaching packages are billed month-to-month as described on the packages page at the time of purchase. Prices may change with notice; changes never apply retroactively to a paid period.
- Payments are processed by Stripe. We never see or store your card number.
- You may cancel anytime; cancellation takes effect at the end of the current paid period. Fees already paid are non-refundable except where required by law or expressly agreed.
- Beta access codes provide free membership during our beta period. They are single-use, non-transferable once redeemed, carry no cash value, and beta access may be modified or ended as the beta concludes (we'll tell you before anything changes).
5. Your content and our content
You own the information you put into the app (training logs, profile details). You give us permission to store and process it to deliver the Services. Everything we provide — programs, templates, the exercise library, the nutrition guide, videos, branding — is licensed to you personally for your own training during your membership and may not be copied, redistributed, resold, or shared. Demo videos embedded from YouTube remain the property of their creators.
6. Acceptable use
Don't attempt to access other members' data, probe or disrupt the Services, misrepresent your identity or health information, or use the platform for anything unlawful. Train within your abilities and follow safety instructions.
7. Disclaimers & limitation of liability
The Services are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim implied warranties and are not liable for indirect, incidental, or consequential damages arising from use of the website or app. Our total liability for any claim relating to the Services is limited to the amounts you paid us in the three months before the claim arose. Nothing in these Terms limits liability that cannot be limited under law, and training-related risks and releases for members are governed by the signed Enrollment Agreement.
8. Governing law & changes
These Terms are governed by the laws of the State of Utah; disputes belong exclusively to the state courts located in Utah. We may update these Terms as the Services evolve; the "Effective" date above will change and material updates will be communicated to members. Continued use after an update is acceptance of the revised Terms.
Privacy Policy
What we collect
- Account & profile: name, email, phone, goals, and coaching details you or your coach add.
- Training data: programs, scheduled sessions, logged sets/reps/weights/RPE, tested maxes, heart-rate zone inputs (age, resting HR), hotel-equipment selections.
- Enrollment & health information: the signed Enrollment Agreement and Exhibit A medical history (conditions, medications, injuries, emergency contact), with signature metadata (time, IP address, browser) that makes the e-signature verifiable.
- Enrollment requests & bookings: name, email, package interest, assessment time, and notes you submit from the website; beta-code redemptions.
- Nutrition guide inputs (weight, height, allergies, etc.) are used for calculations in your browser session.
What we don't do
- We do not sell, rent, or share your personal information for advertising. No ad networks, no third-party analytics trackers, no tracking cookies — the only browser storage we use is what keeps you signed in.
- We never see your payment card details (Stripe handles payment; card data goes to Stripe directly).
How your information is used and who processes it
Your data is used solely to deliver coaching: building and adjusting your programs, tracking progress, allergy-aware nutrition guidance, scheduling, and communicating with you. Your coach can see your training and health information — that's the service. Infrastructure providers that process data on our behalf: Supabase (database & authentication), Netlify (website hosting), Resend (transactional email), and Stripe (payments). Each receives only what its function requires. We disclose information beyond this only if required by law or to protect safety.
Security & retention
Data is encrypted in transit (HTTPS), protected by row-level security (each member can access only their own records), and coaching materials sit behind authenticated access. We keep your information while your membership is active and for a reasonable period afterward for records and legal purposes; signed agreements are retained as legal records.
Your rights
You may request a copy of your data, corrections, or deletion of your account and personal information (we may retain signed legal agreements and what the law requires us to keep). Email Dymefitofficial@gmail.com and we'll respond promptly. Depending on where you live, you may have additional statutory privacy rights; we honor verified requests consistent with applicable law.
Under-18 participants
Members under 18 participate only with a parent or legal guardian's consent through the Enrollment Agreement, and guardians may exercise the rights above on the minor's behalf. The public website is not directed at children under 13 and we do not knowingly collect their information.
